These are checks issued by the check writer to another person who then passes the check to a third person, usually a business. Payroll checks are typical two party checks. Third parties should always be careful and cautious in taking these types of checks. REMEMBER: If there are two parties we need two identifications.

It is possible that two party checks which can not be filed as theft cases may be filed as an issuance case. However, issuance cases still require a good identification of the check writer.

What to do when taking a two party check.

In addition to the procedures listed:

  1. Check to see that the date is accurate.
  2. This eliminates the possibility of receiving a postdated check.
  3. Good Identification is essential to make a criminal case.
  4. You MUST see a Driver's License or Texas Identification card.
    1. Ask if the current address and phone number is printed on the check.
    2. Record date of birth and driver's license or I.D.number on the checkeven if the number is printed on the face of the check.
    3. Compare signatures.
    4. Compare the photograph on the license or I.D. with the person passing the check.
    5. Request place of employment and phone number.
    6. Write your name or initials on the check as the receiver (to file a criminal complaint a witness is required).You many want to see a credit card or Social Security card in order to establish identity.
    7. On checks for large amounts, excuse yourself and contact the bank to determine the status of the account.
    8. When accepting a check that also involves a security deposit, late charge, etc., request
    9. Ask the check passer to identify the check writer if the signature is not clear. If you take a check and we cannot identify the maker, you are at greater risk.
  5. Ask the check passer if he saw the check writer sign the check. If so, indicate that he did with some mark on the face of the check.
  6. If the check is returned insufficient or account closed,
